FPC Files Federal Constitutional Challenge to Delaware's New Ban on Self-Built Firearms, Precursor Parts, and "3D" Files :: 11/08/2021
WILMINGTON, DE (October 27, 2021) — Just seven days after it was signed into law by Delaware Governor John Carney, Firearms Policy Coalition (FPC) today filed a new federal lawsuit challenging unconstitutional statutes enacted in House Bill 125, which established a new, confiscatory ban on all unserialized, self-manufactured firearms, the parts and materials necessary to self-manufacture constitutionally protected arms, and the distribution of any files that may be used to program a 3D printer to produce a firearm. FPC is joined in the case by two individuals whose conduct has been criminalized by the new laws. The plaintiffs are represented by attorneys Bradley Lehman and Edward Paltzik. State legislators denied the ordinary person the right to bear arms in New York. That decision was upheld in state and lower courts. In New York City, the “privilege” to defend yourself with a firearm in public is only given to a select few. You need not apply unless you are an ex-law enforcement officer, a judge, a politicians, or an elite celebrity. That privilege is paid for with political power or campaign donations. Remember that the bill of rights is designed to limit the actions of government. Big government politicians turned that on its head so they could sell our rights back to a select few of us at exorbitant prices. Now, the US Supreme court will decide if the second amendment is a real right or only a forgettable footnote in the bill of rights.

Bruen; the legal challenge to New York’s carry permitting laws that seeks to have them tossed out as a violation of the Second Amendment. Promising Sign For Case Seeking SCOTUS Cert? :: 10/12/2021
Last week Cam reported on the Supreme Court of the United States denying certiorari to three Second Amendment related cases. The cases were: Russell v. New Jersey, Weber v. Ohio, and Roundtree v. Wisconsin. Respectively, the cases dealt with the matter of carry outside the home, being intoxicated while using a weapon creating a disqualifier, and a non-violent felony for non-payment of child support. Also noted in Cam’s piece are two cases that did not hit the cutting room floor as of yet; Young v. Hawaii and Association of New Jersey Rifle & Pistol Clubs v. Bruck. Those cases deal with the matter of “open” carry of firearms in Hawaii and New Jersey’s prohibition on the possession of detachable box magazines holding over ten rounds.
